Appeals of the Court of Appeal
The Court of Appeal is not necessarily the last word. Parties who are unhappy with the decision of the Court of Appeal can try to appeal to the Supreme Court of Canada. The Supreme Court of Canada will not take all cases however. Usually, they will only grant leave to cases that are of national importance. Criminal cases, however, have a right of appeal to the Supreme Court of Canada when at least one Court of Appeal judge disagreed with the decision of the other judges.
Decisions by the Supreme Court of Canada are binding on all Canadian Courts. No court may overturn the Supreme Court of Canada except for the Supreme Court of Canada!
